General Terms and conditions
1. SCOPE OF APPLICATION
Ender Sport Trend Fashion AG with its registered office in St. Moritz (hereinafter referred to as Ender Sport) is an online retailer of clothing, shoes and accessories with a sense of design, quality and sustainability. These general terms and conditions apply to all orders placed on the website http://www.endersport.com in the version current at the time of the order.
2. ORDER AND CONCLUSION OF CONTRACT
In the store you make an online order. The order is binding when you have agreed to the terms and conditions and have pressed the order for payment button. This creates a legally valid purchase contract. After receipt of your order, you will receive an order confirmation from us by e-mail.
3. OUR TERMS OF DELIVERY AND SALE
After the order confirmation, we will send you the ordered items to the delivery address you specified in the form of a package.
The usual delivery time is 3-5 business days for Economy, 1-2 business days for Priority.
For orders from abroad, the delivery time may be extended by up to 10 business days.
If the delivery of the goods fails despite several delivery attempts, Ender Sport can withdraw from the contract.
4. OFFER
Our online offer is subject to change and non-binding. As a rule, the items offered in the online store are available. If it is not possible to deliver one or more articles due to a stock discrepancy, Ender Sport will inform you as soon as possible about this circumstance and offer you equivalent articles. If none of these articles suits you, the amount will be refunded.
5. PRICES
Our sales prices are ex stock and are quoted in Swiss Francs including VAT and excluding shipping costs.
6. YOUR SHOPPING ACCOUNT
For orders in our online store, the payment options indicated there are open to you. With the first purchase on account, we will open a purchase account for you – assuming a positive credit check – through which all purchases, payments and credits will then be processed on an ongoing basis.

For an order within Switzerland, with a value of goods of more than CHF 300.00, there are no shipping costs.
For deliveries within Europe and the rest of the world we charge the following shipping costs:

If the actual shipping costs exceed the amount shown by more than 10%, Ender Sport reserves the right to charge the difference.
Transport insurance will only be taken out on written instruction of the orderer.
8. PAYMENT OPTIONS
For orders the payment methods credit card, PayPal, prepayment, SOFORT payment and Postfinance are available.
9. GIFT CERTIFICATE
Gift vouchers are vouchers that you can purchase. You can pay your order with a gift certificate from Ender Sport. To do this, enter the code on the voucher in the appropriate field of the order. A gift voucher can only be redeemed before the completion of the order process and for the full amount.
The amount of the voucher is predefined. The vouchers are issued exclusively in CHF and are freely transferable.
Cash payment is excluded.
10. PROMOTION VOUCHERS
Promotion vouchers are vouchers that cannot be purchased, but which we issue as part of promotional campaigns. Promotion vouchers are redeemable only under the conditions mentioned therein, by the respective recipient, in the specified period and only once per person. Individual products may be excluded from voucher promotions.
Promotion vouchers can be redeemed for a minimum order value of CHF 30.00; the value of the goods must in any case be at least equal to the amount of the promotion voucher. Any difference to a higher value of goods must be settled with the payment options offered. Promotion vouchers are neither paid out in cash nor do they bear interest.
A refund of promotion vouchers in case of partial or total return of the ordered products is excluded. Promotion vouchers can only be redeemed before the order process is completed. A subsequent credit is not possible. The promotional voucher is not transferable and may not be combined with other promotional vouchers. If you have used a promotional voucher in your purchase, we reserve the right to charge you the original price of the goods you keep if – due to your cancellation – the total value of the order falls below the value of the promotional voucher.
11. RESERVATION OF OWNERSHIP
The ordered goods remain the property of Ender Sport until full payment has been received.
12. RIGHT OF REVOCATION/RIGHT OF RETURN
You can cancel the contract within 10 days after receipt of the goods with a description of the reason for return by returning the goods. The return of the goods is at your responsibility and expense.
Only items that are absolutely intact and in perfect, unworn condition will be taken back. In particular, worn, soiled, damaged or bad smelling products can not be returned. Should this not be the case, we reserve the right to claim compensation.

The amount of a returned item will be refunded in the form of a voucher or a cash refund. Shipping costs will not be refunded.
13. DELIVERY DEFECTS
We ask you to immediately check the delivered items for accuracy, completeness and integrity. Complaints regarding the scope of delivery, material defects, incorrect deliveries and quantity discrepancies must be reported to us in writing by letter or e-mail within 5 working days after receipt of the goods. The defect will be examined by Ender Sport immediately. If the defect is accepted by Ender Sport, you will receive an identical replacement item, if available, as well as a refund of the shipping costs. Otherwise, you will be refunded the full amount.
14. WARRANTIES
The warranties of the items purchased from Ender Sport are limited to the warranties of the respective manufacturer. In the event of improper handling or personal intervention, any claim will be void.
15. PRIVACY
The protection of your personal data is very important to us. We observe the applicable data protection regulations and secure your data against unauthorized access by third parties (data security measures).
Our online store is encrypted by means of SSL (Secure Socket Layer), whereby all data of the offer as well as your payment and customer data are transmitted safely with us.
Ender Sport is entitled to use your personal data to send you special offers or information about new collections. You can withdraw your consent to the use of your personal data for promotional purposes at any time by sending an email to info@endersport.com.
We secure our website and other systems by technical and organizational measures against loss, destruction, access, modification or distribution of your data by unauthorized persons. Access to your shopping account is only possible after entering your personal password.
This website contains a Facebook button. By activating the Facebook button, you are directly contacting the social network Facebook. Facebook uses personal data of its users in a way that may not comply with data protection laws, as insufficient information is provided about the use of the data. Ender Sport Trend Fashion is not liable for any damage caused to you by misuse of your personal data by Facebook.

16. APPLICABLE LAW AND PLACE OF JURISDICTION
The contractual relationship between you and Ender Sport is governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (UN Sales Convention). Place of jurisdiction for all disputes is St. Moritz. Ender Sport is also entitled to choose the court at the registered office / residence of the customer.
